my daughter was 16 yrs old when her mom told me about her. Since I found out that I am the father i have taken care of her.(car, clothes, spending money, computer, phone etc.) She lives in another state CA. Now she feels I should pay for not taking care of her since she was born. She is not a us citizen, she came to the US when she was 16 yrs, she is now 20. From a legal point where do I stand?

You can be asked to pay back child support, from birth. Even if you had no idea.

Given that is not a US citizen, things could be more complex, however.

You need a lawyer, no two ways about it.

How long do I have to pay child support?

Child support generally continues until the minor child emancipates or until otherwise noted in the child support order. Under California law, a parent's obligation to pay support continues until the child becomes 18 years old. However, the current support obligation may continue until the child is 19, if the child is unmarried and attending high school full time. A court may order current child support to continue after the child emancipates because of special circumstances.

If there are arrears (past due support) owed on the child support case, the local child support agency may continue to enforce collection of the arrears until the case is paid in full, including any interest that may have built up.

I hope this answers your question the wording of the question is a little confusing.

It's generous of you to shell out the money for that, and I'd reccomend that you take a paternity test to ensure that the mother is telling the truth (no sense in paying for someone else's kid). If your daughter is now 20 there is nothing to pay for. Back Child support is generally recieved before the child turns 18, and in most cases does not span the entire childhood of the minor child.

Sounds like you're being scammed. Was paternity ever legally established via DNA testing? If so, you've done the right thing by taking care of your child since you found out about her.

Federal guidelines prohibit setting child support retroactively--courts can only go back to the date of petition (prior to emanciaption) for support. The only exception is when a potential father knowingly absconds to avoid paying child support. If you truley had no knowledge of this child until 16 years after her birth (at which time you took some financial responsibility) then you've done what is reasonably required of you.

If you have not had paternity adjudicated via genetic testing, I would get an attorney and get that testing done. If you truly are the father then continue to love and support your adult daughter as you have done for the past four years. If she is not--I would sue the mother and child for damages.

First off..Get a Paternity test.
Secondly get a lawyer. A good one. If you have 16 years of back child support you are gonna owe ALOT.

Even $200*12 months*16 years.....$38,400 That is a chunk and you will probably not get off with some measly 200 bucks a month. It will probably be double that. Good luck honey.

The courts have a heavy hand when it comes to child support. I would talk to an attorney regarding your specil circumstances but I feel you will be left hilding the bag...to bad it will be empty.

see a lawyer and get your mouth swabbed for a dna test.no one waits that long then demands money.most states it is 18 or 21 but is self supporting ,married working full time ?all these are a factor.sounds like mommies pay check ran out.

the daughter isnt a citizen or the mother isnt a citizen? that makes a huge difference.

those things you bought her are considered 'gifts' by the court, not child support or taking care of your child. its nice you buy gifts, but they dont help keep a roof over her head or electric on, food in her belly daily, etc.

.She doesn't have a leg to stand on not a US citizen child support laws do not apply to her retroactively.Consult a family law attorney
