I have been accused of verbally abusing an elderly client at the care home where i work,by a member of staff, which is untrue.The client backs me up.

It depends, what is the mental status of your client? Does he suffer from Alzheimers or Vascular dementia? What does the family think? Does your care home believe your fellow employee?

Defamation of character is only applicable if you have suffered a finanacial loss due to this. Have you lost your job? Have you been turned away from other jobs as a result? Have you received a pay cut or been demoted?

Civil suits require many things for it to be setteled in your favor (if you decided to sue), much too many parameters to list. Talk to a lawyer, he/she could help you even more.

Write a letter along with the client and address his/her behaviour to the Supervisor or Management. In this event call it instigation, request a meeting with your supervisor to resolve this issue.

If you sue them for defamation you have to get a lawyer and even if you can prove it and win they could just claim bankruptcy and then you'd be left with a huge lawyers bill. Your better off going to management to get them to investigate it and then having them file a complaint with the worker and then they'll be aware of it and hopefully that will put a stop to it.

I'm not sure how the law works in that regard,but i do know you can have that person severely reprimanded,which will make them think before doing this again.i say go for it

you might lose your job...does your work not have a in house court like a board to go before and state your case?
