away permanently. Does anybody know the law, if I were to leave him, would the fact that he has had one child taken away hinder his possiblity of getting full custody? I don't want to lose my kids, I do everything for them, change diapers, feed them.. etc. He doesn't do anything.... Any advice would help... I am just scared of losing them..

the child is his, and no, it was not on abuse or neglect... he was told by the cops that he was not supposed to have the mother visit the baby, and he let her come and see him... the cops found out... his son got taken away... he was supposed to go to classes and stuff to get the baby back, and never did so... the child was taken away permanently...

During a child custody proceeding the Judge will take a look at the previous incident as to why the child in question was taken from him. The judge will also want to know if your husband has steady income and can support his children before ruling who will get custody of the child, child support issues and visitation rights, if any. If you file for sole custody of your children you must provide evidence that your husband is not capable of handling the children. You should discuss this issue more with your attorney.

If it were me i would take my kids and leave him at least for a short time.. You cannot afford to lose your kids... Was he abusive to his other child at all or just neglectful? What was the reason he lost his child for good if i may ask? Also talk to children services if need be and maybe even a lawyer.

Yes, it will reflect his ability to care for these children. My ex went throught the same thing - and they assume that if you lost one, you probably shouldn't have custody of the others. They will take this into consideration. As for you - unless you are a complete flake, you would get custody of your children. Mothers always win out, unless they are deemed unfit - which would take alot to prove. Don't let fear stop you from doing anything.

If your husband has been permanently barred from one of his children. The best he could hope for would be supervised visits with your children. If he has been deemed an incompetent parent he will be allowed only limited custody. You would be the custodial parent for your children.

well the question is why was the child taken, was it by cps? Im assuming so. If you can get documentation of this it will provide your lawyer evidence of past neglect/abuse. Also it is important if he is the legal father or the bio father.
