because he caught a man raping a 9 year old little girl, and he phyically beat the man to death. This little girl was bleeding from the severity of this rape, the man who beat the rapist to death has a 9 year old daughter. This little girl was found missing from her home, her parents and their friends went looking for her. The man who beat the rapist to death did so in front of the child, he said he just lost it , he couldn't believe what he was seeing, he said he just thought about his own daughter and snapped. Do you think it is fair that this man remain in prison for the rest of his life with no parole?

He did have prior felonies for gun possesion, but not for violent crimes and the judge used the 3 time loser law on him.
He has exhausted all rights to appeal.


To Sgt D -he was sentenced to life WITHOUT parole, not life there is a difference. And in most states life is equal to about 15 years.

My source is myself- the man who was convicted was my younger brother. Like I said he had prior felonies for gun posession, the girls family evev testified on his behalf, this little girl views my brother as her hero, she writs to him & sends him drawings all the time. He really isn't a bad guy. He just had priors in his past over 5 yrs ago that is why he got life WITHOUT parole.

To Down Home- You are exactly right! The judge took in consideration that the child witnessed this beating and was truly angered by that, but please take in account he pulled him off of her.

There are always two sides to a story. Was this a JURY trial of his peers???? I find it strange that so many people here would not agree with his sentencing yet a whole jury did agree. Where can we find out more about this??? Do you think the jury thought the little girl was more emotionally scarred from watching a man being beat to death in front of her than she was from the rape? I'm sorry but there is not enough unbiased info here to give you an unbiased opinion on whether it was "fair" or not. I know from working in the criminal justice system that things are not always what they appear to be and once you hear the rest of the facts, you can see more clearly.

Personally, I think he should have gotten some leniency due to the nature of the circumstances. However, we can't turn into a society of vigilantes, either. At some point, we need laws or we would be running a muck. Worse a muck than we are running right now.

DEMON - I just read your updates. I am sorry for the situation. That is hard to handle when it's your own family. However, based on the new issues you have brought to light, I have to say I personally would not change my answer. Your brother knew he had to watch himself. And I don't think he had the right to beat the man to death, no matter what. There are women in prison for life...no chance of parole...for murdering their abusive husbands, too. While I think their cases are justifiable as well, it all boils down to the fact that indeed, they murdered someone. Just as your brother did. It must be absolutely heartbreaking for your family. I will be praying for your brother, that someday the ruling will be overturned for a lesser sentence. Never lose hope.

The recidivism rate is very high among convicted criminals, about 80%. The odds are very high that a person getting out of jail will commit another crime. Statistics do not support your belief that they be given another chance. Prison is pretty close to hell on earth, even in the US. Criminals don't have much of a chance coming out better than when they went in. In the Pittsburgh, PA area, a man was released from prison 19 years after being wrongly convicted of rape. DNA said he was not guilty. He has been in trouble with the police three times in 2006. In one case, he was looking to hire a man to kill a former girl friend.

I dont think so! I would do the same for my child if I saw the rapist! A 9 year old can defend herself with a person twice her size so someone might as well do it. Cuz if the rapist got charged, his sentence would be nothing compared to how much damage he did to the little girl. The rapist deserved what he got!

I think the court should consider mitigating circumstances. A good defense lawyer might have successfully argued temporary insanity in this case. Considering that the man had a daughter the same age as the victim, it's possible that mentally he was substituting his own child for the actual victim.

Initially I would say a lesser charge would be in order but would need to read more about the case. Could you site your source?
The assault on the girl is an egregious offense and the defense of her person by her protector must be taken into consideration as well as her psych eval. and deposition and testimony.

No, he it isn't. I do understand that he murdered somebody, but I think any man in the same situation would do the same thing.

They should have charged with with manslaughter & a heavily reduced sentence. There's no real way that he could have stopped himself.

Killing is not right, but if it's going to be more "justifiable" in any circumstances, it's this one.

No i think he should have been give"n a metal.The cops catch these bastards,and the courts give them a slap on the wrist,or a couple of months in a mental hospital,and 9 times out of 10 they do it again! These kind of animals are cowards that single out children because they are trusting and not able to defend them selves! These animals should have their penis and balls cut off instead of being sent to a mental hospital for a couple of months,then good people wouldn't lost their control and kill the sick bastards.

No, not at all. This type of response is very human and should not be treated like a crime - it is an action of protection of the weak.

He should suffer no penalties for this - he saved the girl and did society a favor. It's sad that the law and government no longer recognizes the distinctions between criminals and law-abiding citizens.

Justifiable homicide as far as I'm concerned. If I happened upon the rapist, he would have "disappeared" never to be seen or heard from again. At least, that's the way it is here in the south.
