you can be arrested for swearing????? I don't believe it!! I thought sticks and stones will break my bones but names can never hurt me. What is this country coming to?? I'm flabergasted. Admitedly, the people were swearing whilst talking to a copper.

This offence is not for swearing but for words and behaviour which may cause offence,swearing does offend some people and it is police job to enforce that law .There are other laws which do make obscene language and offence by itself.As someone else said it is great evidence for breach of the peace and drunk and disorderly.The answer is dont use it in front of people you dont know and youll have nothing to worry about.

Depending on lots of things, like the nature (racist homophobic ect), severity and circumstances; your offending history and whether you have gone guilty or contested the charge will also affect sentencing. Most likely result will be a fine, with cost possibly added. So around £60-£300. They often will give you a suspended sentence (ie you get 1 month in prison but only serve this if you get convicted again within a set time, normally two years) but that would actually be nearer the harsh end of the scale.

Disorderly conduct, drunk and disorderly, disturbing the peace - all of these can involve swearing. Now we are not just talking about casual swearing here - this person must have been particularly abusive before a policeman will feel that the only resolution he has is to arrest the offensive person.

And these are not new offenses, they have been in law for many years.

You only get a £40 fine under section 5. My mate got a fine for biting a copper and trying to escape from the van

Anything that can be construde as offending other members of the general public can be arrestable under the public order act.
Even spitting in the presence of an officer.

Yeah my mate's Dad got arrested within the first week for that. They warn you first so whether it's a stupid law or not you haven't got an excuse really. I'd rather keep hush hush & kepp the £80 to myself.

This has been around for ages. It is because coppers don't want to have to put up with abusive language whilst they spray you with CS gas.

since someone was arrested for calling a police horse ' gay ' nothing suprises me anymore...........you can take the lefties out of labour only for so ... you cannot legislate for everything in life which seems to be labours utopia
