We have paid an extremely high amount for a long time and we just can't afford to pay our bills and this amount. What can we do? My husband is trying to get his own business going so we can live as we did before but this is very hard and he hasn't had a check since the first of November.

Before you people start bashing us, I am paying right now out of my pocket and it is double the child support I get. I have been through times my ex couldn't pay and I understand people have problems, I never did anything but assure him he could always see the kids. I just need some temporary relief of a hard situation. We shouldn't have to provide all the money all the time, it is equal. If you aren't trying to help, why are you on this sight? It is not for bashing people, it is for helping.

It would be up to the judge. He would look at the past circumstances and see how he was in the past and make sure this is not a ploy to just get out of pay his support. You can at least get a suspension that prevents him from going to jail for not having payed his support. If he gets his business up and running then he is going to have to pay the same amount of support as he did in the past ex specially if you are living the same life style with the same income.

Most courts put children first. It's not like your husband lost his job. He chose to quit or do something that he couldn't financially handle. So he is supporting a child, that isn't yours?? sorry, u weren't clear about that. if so, I'm sorry but that child has needs obviously if he cant provide the money, then he cant. U could negotiate that in court, but all in all, once u financially stable again-the support costs may be raised again.
