Mediation, by definition, is to find a way out based on compromises and friendly negotiations. Divorce lawyers are ready to go nasty.

The decision is up to the couple, who have the sense that divorce costs both sides a lot of money ($10k-40k). Still, mediation should be settled by lawyers so one party doesn't come back and complain unfair treatment. The lawyers then get the court to order the divorce.

Mediation is the process by which two divorcing parties come together in an attempt to settle all matters related to their case. Generally speaking, mediation is attended by the mediator, both parties and their attorneys, if represented by counsel. In some jurisdictions, mediation is mandatory before you are ever allowed into a courtroom. Therefore, most attorneys are familiar with the process of mediation and encourage their clients to come to an agreement with their soon to be ex-spouse.
