My Mom had a stroke and will not be returning home.I am an Adult son who has returned home.At one time I was on the lease.Years ago I left home years ago.I have not been able to obtain the lease to see if I am on it. The manager will not let me see the lease. I live in New York City.Do I have a legal right to see the lease?

Not if you're not on the lease. If you were on it, he would have to supply you a copy within a reasonable time frame of asking. If Mom is able, have her call and ask for a copy to be sent to her, so you can see it. If not, a Power of Attorney should do the trick. If not you, then who is legally handling her business? It could involve getting this done through the courts, if nobody has been assigned.

I am no lawyer but my best guess is that if you have not signed a lease in years then you are not on the current lease. Due to privacy laws the manager probably cannot show you anything without a written release from your mother. If your mother gives you power of attorney then I believe you would have the right to see the lease. If she is not medically able to give you power of attorney you will need an attorney to help get her affairs in order in more areas than this. If you want to see the lease you will need authorization from your Mother. A Power of Attorney document, etc, from her will give you the authority you need. The manager has no way of knowing whether or not your mother wants you to know how much she pays for rent, etc, etc. He is protecting her interests and privacy.

As others have noted, if the manager won't let you see the lease that most probably means you are not a party to the contract.

What you really need to do is ask your mom if she can remember if you are still on the lease. If she can't remember or says that you are then you need to get a lawyer and do something about it. You really haven't said why you want to know if you are or not so I really don't know what else to say. Good luck with this.

You need legal Power of Attorney unless you were 21 and cosigned the lease. If he is not willing to let you see the lease then you need an attorney. You will probably need the power of attorney anyway.

Yes, so get in touch with the owner of the management company. I take it you are living in the apartment, and as such you have a right to see the lease.

You may have to get a power of attorney from your mother.

Do you have a front door key? If so your mom probably has a copy of it saved right there.
You may need a court order to enter otherwise.

I'm guessing that he's refusing to let you see it because you're not on it.
