i need to know how to collect a debt, i did some work for a general contractor, iwent above and beyond the call of duty for this man. he is trying every trick in the book &looking for any reason not to pay me. there is no rational talking with this guy,he resorts to threatening verbal abuse towards my crew and myself. i did work for this man once beforebut he had a business partner who was a stand up guy.this other partner paid his bill upon completion. i shouldve seen the deception when he advised me not to contact his "partner"for any reason.i made 1 mistake by trusting this man.we had a verbal contract. i figured this was ok because ive never had aproblem like this before.are there any ways i can collect my money legally? any suggestions?

have you try calling his ex-business partner and telling him what is going on....maybe he could talk to this guy for you....

Having nothing in writing is going to go against you....do you have an impartial person(not a buddy-or part of your crew or theirs) that witnessed this verbal agreement ?...if you do...you might be able to get a sworn statement from them and take the person to court...but it will still be like your word against theirs.........

man, that is a bummer....always get things in writing...no matter what........taking this guy to court is the only thing I can think of..and since you have nothing in writing..it could go either way.....and you could end up with court cost on top of it......

You have every single right to sue this person. By agreeing to help him- if he offered to pay you or offer compensation in ANY way, he is violating a contract between the two of you. Even if the contract was verbel (aka known as "Expressed") this is enough for the legal system to make a case. It is worth it- as this could stop this person from continuing from treating other people like this. I would sincerely advise you talk to a local court or private lawyer.

1. Write anitemised bill (showing work, time and materials) addressed to him and his partner or in the company name. Send it to them and at the end of it state the date that you expect payment. Usually within one week of date appearing on bill. This is so that you can have some written paper to take to court.

2. Call the partner and let him know that you are looking to collect on your bill. That he is refusing and that you are intending to take their company to small claims court. Bring his attention to time you expect the bill to be paid.

3. Should no payment be received withint the time given, have documents for small claims court prepared...file your documents in small claims court by the end of time given.

4. Make sure that if you had purchased any materials to do the work you have all of those receipts as well for presentaton in court to back up your claim.

See him in Court.
