Ok people, she has been with this man for three years, so it is likely that they have been "separated" for longer than that. So, let's get past the "homewrecker comments". Even if he is still techniclly married, his isn't.
both parties do not have to sign the divorce papers. When you see people signing the papers, that means they came to an agreement, and the divorce is not actually going to go to trial.
If she will not sign the papers, go to court. Given that you two have been apart for this amount of time, the divorce will be granted. Since the child has been residing with the father for this time, likely that the father will be made primary in joint custody. Now, she will likely be ordered to pay child support as well. A visitation schedule will be set as well. You will have to allow her the visitation as it is stated in the order. If you do not, you will be in contempt of court for disobeying a judge's orders. If she does not show up for the set visitation, she can be as well, but you would haveto press the issue.

In most cases as long as you make a good faith effort to serve papers a divorce will still be granted. She does not need to be present for the divorce to take place. If you can hire a lawyer they may be able to file everything so you can move on. My ex did not show up and I was still granted a divorce(I live in Florida).

I think after a length of time there is no need for her to agree the courts will see they have split and he is living with you now and so allow the divorce. One party cant refuse and hold you to ransom

It doesnt matter if she wants to sign it or not...Go to court the judge will still make the divorce final.
She's probably doing it because she wants him back most people dont realise what they have until its gone.

Why does his ex not want to divorce him now?? Why the change in mind... Is he still seeing her on the sly? Sounds to me like he is... You need to ask him why .... Move on with your life and get out of this situation now and when the divorce is finalized and he has the evidence to prove it then maybe you can date him again. I think he is playing the both of you here.

Well, maybe this will teach you not to get involved with a man who is still married.
There's really nothing that you can do about the situation right now. It is up to you to decide whether to stick it out indefinitely and wait on a married man, or whether to rid yourself of this burden and move on with your life.

have him talk to attorney, ifs its a no fault or can't get along divorce she wouldn't have to sign if the judge apporves it, especially since they've been apart 3 years now.
