I have a really nice, late model, fully loaded, BMW. I took it to the BMW dealership for standard service. A few days later, I got a call saying that the car had fell off of the lift and suffered extensive damage. They promised to repair all damages and get it to pass the BMW pre-owned car certification. However, I am afraid the damage will be posted on carfax, and that my vehicle has lost value. In addition, they are not offering a warranty, and there is no gaurantee that future related problems will not arise. Do I have to accept this vehicle back, or can I demand them to get me a comparable replacement vehicle, or compensate me for the fair market value of my vehicle? Any help would be appreciated...for you lawyer types, can you cite some cases related to this. Thanks!!!

If possible, get some pictures of the damage, they may be needed later on.

I don't think it would be reported to Carfax since there will be no police reports, but not really sure.

The shop should have insurance to cover things like this, and they will likely file it on their insurance unless it goes below their deductible (usually a pretty high deductible to keep their costs down). My main concern would be if there is subsequent damage found later on, or the repairs need to be redone later. They should warranty their repair work on it.

Depending on how extensive the damage is (for instance if it exceeds the vehicle's value), you might be able to get a comparable replacement vehicle (or the fair market value of it), but this would probably require going to court.

Laws vary by state, so best thing to do is contact a local lawyer and see what they tell you.

It also sounds like they don't want BMW headquarters to know about this incident.

i had my truck serviced for an oil change the door got jammed ,they pulled out the jam. the door opens now could that have damaged anything else?
