I am moving next week, and I gave the check to the manager of the new building but the documents we filled out were the application form I just realized that this is not the contract, but he already gave me the key. The check was made to his name and he wrote the amount received on the form. Should I be worried?

Your state's landlord's act covers you as to the status of your tenancy. The fact that he wrote you paid on the application form should be sufficient proof that you did indeed paid (hopefully he either signed or initialed the paid entry) However never enter into a rental without specifying the terms and conditions of the rental in a written agreement. Get a signed lease, it might be that you will discover performances expected of you that you will disagree with or terms and conditions that are not acceptable to you and not disclosed on the application form.

I have rented in the past without a lease and it was on a month to month tenancy. You haven't stated much info. I was usually pretty lucky in those days and the owner always kept the property up. I believe that all I had to do to move was give thirty days notice to get my deposit back. You need to have a further talk with your landlord so that you understand exactly what you are getting into. It is better to have a lease that spells out everything expected of you and exactly what your landlord is responisible for. I own a duplex now and would never rent without a signed lease. LOL
