You asked if you could:

I say yes, you can.
You might be able to sue them but, to win, I don't know.

You do know that your son has Epilepsy. That means, you do know he should have avoided the computer screen in the first place.

Another thing is, many web site has this disclaimer, conditions, terms of use, agreements, or whatever they called it.
In there, they might have already warn that the content of such website may have "blinking or flashing effect" and, that people with Epilepsy should use at their own risk.
If they do have that on this website you are talking about, they're pretty much saved.

If you asked "Should" you sue:

No, it's partially user fault, even a little.
I mean, no one in this world can please everyone completely.
If it's something that you can prevent(be more careful), then you shouldn't blame others for not having things the way you want.
Like, they didn't force your son to go to this website. He has a choice and, make his choice.
What ever happen then, all of you(your son, the website) should share the responsibilities.

Your son has to be more careful about internet(computer screen, etc.)
Report to the website, tell them your story.
Ask them if they could remove/change the ads for the sake of others like your son.

Peace, is a nice thing. We all should try it sometime.

Most websites state you must be 13 or older to use, even yahoo messenger, this site and msn messenger. So depending on the age of your child you may be responsible for your child's action or if older than 13 they would be responsible for their own actions. There are no bans on ads or the graphics they use. It all comes down to reason, having the knowlegde of reasonable risk.

You might be able to. But you shouldn't.

Why? Because it's another case of a ridiculous, frivolous lawsuit in a sue-crazy society.
