my parents usually claim him and me since we live with them i only live with my boyfriend maybe 4 months out of the year off and on. ym child is 16 months old and he does not pay child support. my parents provide most. i dont work i go to school. he is not listed on the birth cert as father. can he legally do this

Nope. The person who claims your son should be the one who provides for him for the majority of the year. This would usually be the parents. Your parents can go ahead and claim your son on their taxes even if your boyfriend does (without your permission, of course). Because they have been the ones claiming him, your boyfriend will be the one to get audited.

If he's not listed as the father on the birth cert., he absolutely can't do it legally. If 2 people claim the same person twice, the IRS maybe sending you a letter down the road, asking for details, proof, etc.

definitely you should claim the baby. he is going to probably owe no matter what. the more a person gets back these days is a blessing to anyone. if he loves you so much, he should let you claim the baby, get the refund and use the money as mom's need to. I don't know Canadian law, maybe he should consider checking into tax laws with an American citizen as a dependent, if it is really worth more for him or not. My vote is for you.

I agree with number three for no reason. My thought is let him and then Force him to pay Child support. If he has income, he should make a token jesture atleast. He might get a double whammy. IRS Audit and Forced to pay CHild support. Nothing makes me happy more than seeing a dead beat dad suffer.

you need to make sure that your parents claim him. thats messed up why would he even think he could claim him? dont let him use your child for money. that is one sick man. does he know your childs social security number? your parents should file first.

do not let him claim the child. if he payed child support maybe you should. but if he doesnt dont let him. he should be paying support.
