He has been working on a big business deal that will come to fruition soon. I know he will try to kite the money away or convince his partners to keep the money owed to him and pay him after his divorce is final so I cannot get any of this money. I gave up my job where he currently works so he could have this opportunity and I put all of the money I made on the sale of my house before we were married into our house now and because of that we were able to put 50k into this business deal from a home equity line. Will I be able to reap some of the payoff from the deal? Can a court go after future earnings? We have only been married 2.5. years. He stands to make 50k a month for two years then 25-40 million after the final payoff in two years. The state is Florida.

You should get a lawyer immediately. It is a duel. Also, it depends on whether you have clear documentation. If you have evidence to sue the partner, he might not want to be party to a con game.

If you saw that coming, you should have better planning.

If you have legal claim to an investment, then you are entitled to your share in the future. Most partnerships hate that because they can't sell the business unless you also agree to sell. You can use that angle to threaten his partner.

You need to see a good lawyer and fast! You will need someone who can make sophisticated legal arguments in order to get what you deserve out of this situation. First, you lost income because you quit your job. You put the proceeds from your house into the relationship (he can argue gift to the marital estate). You guys now share a huge debt. Future earnings are by their very nature speculative but if they can be proven with some certainty you might have a chance.

Find out who the best attorneys in town are - get in to see one for a consulation and find out what they recommend.

You can only take half of what you both built together.
Also if you were put in a position where you were not financially okay because of him and he was able to get financially ahead of you and he leaves you with that burden you can ask for spousal support and have him pay you for up to 1 year until you get back on your feet. If you are the one who left.. you shouldn't get spousal but you can still get half of what you built together. It's better to part ways in peace and not try to suck a person for everything they are worth.

Do not grant the divorce. Do not sign the papers. When it goes ot court tell the judge why you will not sign they can lein him for up to 5 years i believe it is and he can notl ive without money for 5 years.

If I were you I would certainly speak to an attorney and explore the options. It also depends on whether or not Fl is a communtiy property state.

you should have already had a lawyer in the wings, if you know
that he was going to serve you papers. now you have to
get al the information as stated second hand, and if he worth
all this you are in for a hard fight, i hope that it work out for
you.

Your attorney committed the same sin as he and his attorney did, missed the allotted filing time and acknowledged status with further productive action. You are toast on going back in time now.
