While the obvious answer is nine (9) you could argue that there are ten (10).
The Solicitor general is popularly considered the 'tenth' justice. The amicus briefs that get his support have a great chance of being heard before the supreme court. The solicitor general also argues cases for the United States but when he talks, the Supreme Court listens.
