I had twin boys out of wedlock and gave them my maiden name. Their father and I are now married and we would like to change their names. I can't seem to get a clear answer on how to do this. Some say that I need to just go through the court system and some say to the amend the birth record. HELP!?!

You will need to petition the court for a name change for the boys. Usually this is just a matter of filling out a few forms, then publishing the new names in the paper several times over a period of several weeks. This is a procedure that is set out in your state statues. Check with an attorney in your area, or a legal services clinic for guidance. Once the Judge has signed the Order approving the name change, then you would use that Order to amend the birth certificates. If your husband's name is not on the birth certificates, and you want his name added, he will need to sign an affidavit of some type to acknowledge paternity. Laws vary by state, but you will most likely need to file a petition for a name change. That is the procedure here in California.

The good news is that many courts are becoming more user friendly to people representing themselves. Contact you local court to see if they have an information pack on this topic. If not, most lawyers will give a free consultation on new matters and you might get some good advice on the subject.

Call your local court house, usually the vital records department. They will give you all the info you need. Basically, you'll fill out a bunch of forms and appear before the judge. This does not sound like a complicated name change at all, so it should be very easy for you to do so.

My sister in law had to do this in Alabama years ago and they just went through the court. The father had to legally adopt his own child. I don't think the birth certificate was ever changed though.
