Recently, I became aware that my employer has been making deductions, in the amount of $225.00 on a weekly basis from my paycheck, along with approx. 12 other co-workers, for our share/payments towards our co. healthplan. This occurred for 8 weeks. We've been notified that our plan has been terminated for lnon-payment, as of Dec. 01. 2006. for myself and others it would cost each of approx. $3400.00 to reinstate this plan, plus an addl. $1700.00 for febuary's premium. Obviously he misappropriated (stole) our funds. Now we're unsure as of yet, if even our taxes, and FICA have been paid, (We don't think so).My dilemma. He owes me alone approx. $8500.00 in unpaid/wprked for salary, plus all that he stole. We still have access to the facility and I'm wondering if it were....wrong?...to take possession of some of his equipment, i.e. computers, tools etc. Nothing with sensitive value, but things with monetary value. WE ARE NEVER going to get the monies due us, as he is going bankrupt.

All of the above. Don't take things into your own hands or you'll end up being the ones in trouble with the law. You have enough grief right now, don't make things worse.

Stick together. Get a lawyer who specializes in representing workers in labor law disputes. Ask around to find an attorney who is SUCCESSFUL in this area. Maybe there are some union folks you know who can ask union leaders who would be good????

You can also contact your state's employment or labor department (different states call them different things, I believe) and see how they can help you but you should talk to a lawyer first. A lawyer might be able to help you better before you talk to the government.

Going bankrupt is one thing, but withholding taxes from your pay and not paying the taxes is a criminal offense. I'm pretty sure your boss will want to straighten things out BEFORE he files bankruptcy.

GET A LAWYER first thing. The sooner the better. Monday morning at the latest, if not yesterday!

No you mustn't checklist him. too quite some that "flip on your chum" stuff in this u . s . a . those days. seek advice from him and enable him understand that what he's doing is the two unlawful and unethical - and that's in basic terms a rely of time previously he gets caught. tell him you do no longer go with to take heed to different persons's problems. If he gets destructive comments from people who understand him, possibly he would be certain that's not so smart and quit.

Foolish, desperate, illegal....borderline on the ethical depending on who's ethics. One, you're desperate, duh, the guy's got a bunch of your cash and it sounds like you're going to be out of a job any day now anyway. The only way to legally get your money is through the courts....anything else, including what you've mentioned, is a strict legal no-no. It would be foolish to carry out your suggestions, because any investigation would point right to the disgruntled employees....not to mention you'd probably try to unload the stolen gear at the local pawn shop, through the newspaper, or some big named website using a local mailing address....all of which the cops watch. You'd be better off just knocking off his house, which I'm NOT advocating....just go to the cops.

Hello: It sure would be nice to walk in and out of there with some of their equipment. Unfortunately, YOU would be arrested in not time for theft........ Please stay within the confines of the Law. First go to the Labour Board immediately. They just might hire a lawyer on you behalf. Or, go get yourself an attorney who specializes in these cases. Hopefully you will be able all if not, a good portion of the monies owed to you. STAY COOL and GOOD LUCK!!!!!!!!!!!!!!!!!!!!!!!!

all you can do is call the fair labor board now before he goes bankrupt that way he will have to refund the monies due to you people. Don't wait till he files bankrupt.

Damn...what a spot you're in! On one hand, you don't want to steal, but....it's probably the only way you're going to be compensated at all for what he legally owes you.

My advice would be to find out what the penalties of your "self implemented restitution" would be and decide if it's worth it. Man, I sure hope it works out for you and your co-workers. Good luck.

don't take possesion !! report this immediately..all of you need to stand together what was done is illegall..talk to a lawyer now.........
