My husband and I are in the middle of a contested adoption. We have had this little girl from the age of 7mths to (now) age 3. We filed our taxes today and found out that the little girls birth mother who has not even seen her in over a year claimed her as a dependent. I know we have to file something with the IRS but does anyone know if we can push to send her to jail? This is not the first time she has done this. She cleaned this old mans house the year before and found his ss# and claimed him! He did not press charges, he just made her pay him the money. I want to press charges or something! She is contesting the adoption making our life miserable then on top of that claiming MY little girl as a dependent when see has not even laid an eye on her in over a year!!!!! Does anyone know what could happen???Could she go to jail or will she just have to pay a fine?

You need to consult your attorney, but I'd encourage you to stay out of it, to be honest. You want to win on the adoption based on the merits, not because you took personal action against the other party.

If you insist on acting, then make one call to the regional IRS office, and let that be the end of it.

sorry to be the bearer of bad news BUT my children's father claimed them for 15 years as well as claiming that he was head of household AND supporting a house in another country and this ONLY came to light when I moved to the states and used my sons SSN# the same year he did...basically the IRS did squit about it although he has NEVER pulled that trick again as I have all the proof that I am the ONLY one of us that is allowed to claim him....also during that period of 15 years he NEVER paid child support etc etc.

Last I heard is that he had to make some sort of repayments BUT since then has not filed so its a moot point.

IMO the IRS does not take this seriously enough.

Regards and just make sure you CAN claim your child as a depend ant and it will be OK

I don't know, but you better do something because she is taking advantage of you and is trying to see what all she can get out of you. Time to put on the gloves!!!! I would call the IRS tomorrow!!

no she could go to jail especially if you let them know this is not her first time during it
