My sister purchased a car, from a broker, that was to only need a belt to be A-OK. So she purchased as it. She now has to many problems to even count. The biggest problem being it will not pass emission. Is this against the law?

I'd think no. It is not illegal.

And I think you meant "as is" not "as it".
It is not illegal to own a car that won't pass emissions.
So it is not illegal to sell a car that won't pass emissions. As long as you are not restricted from selling "as is".

Not illegal to sell it. Only illegal to drive it.
A car doesn't even need to have an engine to sell "as is".

I'm not sure about a broker...

dealerships are required by law to sell "street legal" vehicles except in special circumstances (like a vehicle that will not be used on public streets)...

individuals (and I would guess this also means brokers) can sell any vehicle they want in any condition... "buyer beware"

Not all cars have to under go emmissions tests. Not all countys in a state requir emission tests. usually countys or whole states only require it for areas that have high traffic flows. to my knowalge their is nothing making it illegal to buy a car that does not pass a test. if you want to get regisration for it though then the DMV will requir one.

No,it is not against the law,but you will not be able to get car registered in your name without emission test.

You could sell a turd,if someone is willing to buy it.Car dealers do it all the time.
