My husband is a VA resident. VA divorce is a MUCH longer process. I have already aquired a VA lawyer and have started the process (notification of need to come to separation agreement or we will file for divorce). Now that I'm a WV resident (lease signed in Nov 06, continuous residence since 1/3/07) could I decide to file in WV instead? We were married in WV 28 years ago and lived in WV for over 20 years.

Yes,I think you can.I was married in Las Vegas(Nevada),but I got my divorce in Virginia.

You can if you meet the residency requirements like the last person said.... I THINK (notice the word is THINK, not KNOW, lol) that the residency requirement is 1 year. You can call the court house and ask them, and it may be online. Do a google search for wv divorce residency requirement. It should be somewhere in wv state code.

If you have fullfilled the residency requirements in WV then you can file for divorce there unless hes filed for divorce in VA first. The state in which the seperation/divorce was first filed will have jurisdiction over this case and supercedes any other state coming after the first filing. Hope this helps
