Those bands who are obeying the law join ASCAP (which would be beneficial if they are songwriters as well) and pay an annual fee for the license that gives them permission to play all ASCAP-registered songs.

Sometimes the venue itself has the performing license.

It isn't if the band has permission from the original musicians. I've been to a Fall Out Boy concert and they played their Jawbreaker tribute song there. =)
