Okay, I rent a room from this guy. He is never there, but he will just POP in without notice; he may be gone for a week, maybe a day.He is a neat freak and expects everything to look like a model home at all times. We can't even sit on the couch when he is home. Long story shortened he gave us a thirty day notice to move, claiming that he is selling the house. He said he needs to fix up things and get the place ready to sell. He gave a similar story to a roommate when he evicted her, claiming he needed room for the holiday's. I know he is lying to us and just wants his house back, but it is inconvienant to now need to move. I pay my rent every month and follow the rules. I feel he has no reason to evict me. Do I have any recourse against him? PLease help.

No I don't believe you have recourse if he owns the house. A thirty day notice is his only obligation.

No you do not have any legal recourse at all. He gave you the required notice you need. I suggest you move. If you do not, he can seek damages from you for staying as a holdover tenant and forcibly evict you. That usually takes 7-10 days. You now have 30 days...use your time wisely and move.

Note: Your lease is NOT for a term of years....you pay monthly, therefore it is a Periodic Tenancy (or possibly a tenancy at will, which wouldn't help you either).

the problem is did you sign a lease form, if not you may not have a leg to stand on, second if there was no form, he does have to give you a written notice to move out, since with out the form, sound like you were rentting the room for a month at a time, and he has all rights to have you move out, but in some cases if he take you to court, it could take up to 90 days, before you would be force out by law, in some states. the best thing to do move out and and use the money you would pay for next month, to put down somewhere else.

If you have a month to month thirty days notice is all he needs to give you and the law assumes a month to month without a lease agreement to the contrary. Sorry Sam you are S.O.L. He doesn't need to have a reason other than he wants you gone.

You don't have a leg to stand on unless you have a lease for a term of years. i.e., lease that runs from date to date for the entire year. Even if you have a lease like this, it may actually be a month to month lease.

Bottom line is that he can and he did. I understand you are upset, but why would you want to live here anyway if they guy is a freak?

You have no recourse at all. It is his house, he wants you out by giving you 30 day notice he has fulfilled his legal obligations. Find another place.

Do you have a written agreement? If so has he violated it? If he has call the landlord/Tenant dispute center @ legal aid.He has a right to his property if he gives proper notice If you knew of him doing this previously then shame on you for not seeing that it would happen again!
