and as a human resources person, you say, to be qualified for employment, you must not have a DUI in the last 3 years. and then you get a DMV report from someone that had a DUI 3 years and one month ago?

Then that person qualifies for employment. There may be MORE qualified candidates, but that person meets the minimum requirements.

They would make the min standards on that specific issue. HR people usually do not do the actual hiring. They generally get the applications, review them, weed out those not qualified, and then send them to the specific department, division, or whatever is looking for someone. Then, it will be up to those people to do the actual hiring. Then, once hired, HR is the one that handles setting up benefits, first day orientation, and things of that nature.

It's the same rule as credit reports. In the UK, CCJs (Count Couty Judgements) disappear after 7 years.

If it happened 7 years and 1 month ago, then it's gone.

If the policy says three years, then it doesn't matter if it was three years 11 months, or three years and one day. The person meets the requirement. This type of rule is not (and really, cannot be) fuzzy.

The first couple of guys are right, however that does not mean that by seeing that they won't find another reason to disqualify you for the job.
