In our case, the builder had more than one home with problems. With the number of complaints and the threat of a class action lawsuit, he was ordered to stop work on new homes immediately.

I'm not sure exactly why you are contacting the builder. Is it just for him to check the house, or is there an actual existing problem? If it's just for a checkup, the builder would have no responsibility for that unless there was a contract stating that he would. In that case you could take him to court to fulfill his contract.
If there's already a problem that he is responsible for, you need to make him aware that you will hold him responsible for all damages related to the unfixed problem. Builders are notorious for forgetting all about past projects. They have their money already, they have moved on to the next development. You may have to have another contractor fix the problems, then sue the original builder for the cost.

Reporting them to the BBB or having your lawyer contact them is the best way to go. Getting the news media involved can be ugly and the builder will get defensive and most likely not help you at all.
