You are allowed to use deadly force in defense of yourself, a third person, or your home. So, if someone was about to attack another person, and you felt they were at risk for great bodily harm, or death, you could use deadly force to protect that person.

In England, if you shoot the bad guy, the courts appoint a lawyer to the bad guy so he can sue you for causing him emotional trauma, pain and suffering. That is after they arrest you for having a gun and resisting the bad guy.
In the USA, it must be in self defense or defense of another. You must use some sense in how you respond.
If the bad guy was a 70 pound kid with a knife and you are a 220 pound professional football player, I do not think you could make the argument you had to shoot the kid.
On the other hand, if the bad guy was a 220 pound guy with a baseball bat swinging away on someone and you are a 100 pound woman, you could easily argue you have to shoot.

The main thing to remember, is if you can justify your actions, and if neccessary in a court of law. Cop or not, if my life or someones life in my presence was in fear of death or serious bodily injury and the person who is committing this act is doing it without regard to law and life, then yes, I would shoot them or use whatever action I can to stop thier illegal action against me or anyone around me. The last thing I ever want to do is kill someone, but if its a criminal with no regard to law or life, then all I can say, is that "I wil do anything and everything, to come home to my loved ones", simple as that. Private citizens do have rights and they have the right to protect themselves or their loved ones in any way against the loss of life or limb. I rather be judged by 12 than carried by 6. Plain and simple....

If you are personally being threatened (your body, not your purse) I've HEARD that you can use like force.
I'm not a cop so I don't have any code section to back this up. Only a law class I took.

Depends on the bad guy's weapons. If he is armed with a deadly weapon (another gun, for example) then it's ok. Otherwise, you can't get by with the self-defense arguement.
