Shoplifting is a criminal offense, small claim court is a civl court. The two have nothing to do with each other. Your trial will likely be in municipal court in front of either a magistrate or a judge. Courts tend to show leniency in a first offense, but if the defendant has priors, since this is a "Three Strikes" state, the defendant can go away for a very long time.

breach of a written or verbal contract;
back rent;
return of security deposit;
broken or damaged property;
and matters under a certain amount of money which varies from state to state but doesn't usually exceed $5000.

What is Small Claims Court?
A part of Superior Court where you can sue for amounts of up to $5000.
The only exception to the $5000 limit is a suit brought for the return of a security deposit. In this situation ONLY, the plaintiff may sue for double the amount of the security deposit, plus accrued interest, even if the doubled amount brings the claim over the $5000 jurisdictional limit.

No. If someone is arrested for shoplifting a cheap camera, and they are brought to trial, it would be in criminal court. Small Claims court is for civil suits.

No you will go to a court with a judge and then depends on what the owner of teh property wants to do you cna even go to jail. Stealing is worse than what you think and some owners wnat to prsecute to th fullest on shoplifters so tehy can send a lesson to other who want to shoplift. SO be carefull and hope you get probabtion. You dumb fool

They can be charged in a higher court and should be, If you want something, go work and pay for it like normal people. Shoplifting is another reason why prices are high.
