They have up to a certain date, by law, that they have until to give them to you. I am not sure what that date is. If you ask them for it and they still do not give them out, then all you have to do is call the IRS and tell them! My ex-husband had the same thing happen to him years ago and that is what he did. About a week later his W-2 was in the mail! The IRS doesn't mess around when it comes to that. I believe that your employer will be fined as well.

Call the main office of the company you work for and find out the status of your W-2s. Contact H&R Block, they have a new thing about doing your taxes before recieving W-2s.

Inform the IRS of the problem after trying to work out the problem with the payroll office.
