If you file married filing separately, then they can only take your refund amount, not your wife's. You can also file married filing jointly and your wife can file an "injured spouse form" with the return. The refund amounts will be figured separately and they will only take the amount of the refund that is your refund. See IRS pub 17 for more info or speak to a tax advisor. Good luck.

Your wife can file a claim as an "injured spouse" because by law if you file together 50% of the refund is hers. It will take longer but she will get her portion.

If your wife files the injured spouse form, then the refund attributable to her will not be taken, only the refund attributable to you.

That is probably true, now that you are married your finances are tangled, and catching up on your child support is the right thing to do anyways, its a win-win, its not about your wifes refund but about the well being of her step child.
