typically it is considered a gift, so it is rightfully yours.
However, there have been court cases over such a thing. The court had upheld that if the female broke the engagement, then she broke the Implied Contract and therefore since the ring was part of the contract the ring must be returned.

Technically the ring is not and will not be your property, unless your ex gives up the legal right to claim it as his. An engagement ring is considered a conditional gift. You get the ring when you get married. You did not get married so you should give back the ring. The best thing to do would be to contact him and specifically ask him if he wants the ring back. If he tells you to keep it, keep it. If he wants it back, give it back.

If you break off the engagement than you shall give back the ring. If he break off the engagement than it's yours to keep. Yes it was a gift from him but if you two are no longer together do you really want to keep the ring?

It depends on what happened to break up the engagement. He could be nice about it and let you keep it or he could take you to court to get it back. I think it is more of an etiquette and ethical matter. If you know you f*cked up then you should give it back without question. If he f*cked up then he should let you have it. If it is a mutual split with no assigned blame, I'd say just give it back to him and let him get his money back. I would never want to keep it in any case though.

I have heard that legally you would have to give the ring back. The only exception is if you received the ring on your birthday, Christmas, Valentine's Day, etc. because then it would be considered a gift.

the ring is his until the marriage license is signed...doesn't matter if it is 8 months or 8 years. it is given in contemplation of marriage. because of stupid men and gold digging women.

If you don't get married, it goes back to the guy. It was given as a promise that a marriage would take place, and if it doesn't, they the guy gets it.

You mean if you split up? I think it would be legally the owner of the person who recieved it.
HOWEVER... If the woman broke up with the guy... She should just give it back.
If the guy breaks up with her... than she should just keep it.
