My ex husband just got 12 years in prison, for sleeping with a 12 yr old and getting her pregnant, she apparently "wanted" it. But then his father a loooooong time ago slept with his own daughter who was 16 at the time and he gets charged with rape and life in prison. Ok so whats the difference, they are both sick men, (yes I know I married a moron, but as you can see thats why i'm divorced) anyways, so how are these charges different?

ok I wrote she apparently wanted it because, well she knew what she was doing and her mother knew too, and she was the one going over to his house at 2 in the morning knowing what she was doing, this isnt the first older guy that she's been with either, so as much as she seems like a victim in this, its not the case.

!2 years old but she wanted it???? !2 yr olds want a cell phone, make up, clothes, a boyfriend they want lots of things with out even thinking about it I doubt she wanted to get raped and pregnant!!!!!!! Thats no a toy or something that goes away He knew better but didn't care, he should have gotten life & castrated! Everything about this is ILLEGAL!!!!! Whether 10, 16, 4 or 12 they are all children!!!! The age does not make a difference, sure you can say the state recognizes age 14 or 16 etc. but if you do it you are just a sick, twisted, evil, perversed, piece of hell that found your way to the earth.. You will rot!!!!! No one will miss you, some will rejoice when you die. And children will be safe from at least one!!! There is really no difference bottom line they are both minors period... There is no gray area in this situation. As much as they are cracking down on this activity now days it seems like they would be leery and stop doing such things, they will get caught cause people hate it and will turn him in if they find out. The people see incest as the worst crime because they are there own flesh and blood and at there mercy in there home for years. Grabbing a kid off the street and molesting, raping, & torturing is a Heinous crime. But a child is in complete trust & at complete mercy of there parent, and is made to live that way for there entire childhood for fear of no love or there life is much worse I think. A loved one is suppose to protect love and secure a child not take advantage of them raise them as a personl sex purpose and brain wash them into sex slaves or somthing. Trick them with there love for years! I think they all deserve life but escpecially a parent who would do there child that way!!!!!

Unlawful sexual contact is bascially everything other than actual intercourse. Rape involves actual sexual intercourse. If he got her pregnant, it would be statutory rape, unless he plead down to a lesser charge.

The father was likely charged with rape and incest. If a weapon was brandished, it would have been aggrevated. Obviously the manner in which the father did it to the 16 year old was worse than what you ex did to the 12 year old.

If this is the same man you were asking the child support question about, i would plan on basically not seeing any money ever. Best to move on and forget this guy.

It pretty much depends on the state and the year that the crime was committed. Since sex crimes are a state issue it will vary from state to state. What is rape in California could be unlawful sexual conduct with a minor in Ohio. Chances are your ex husband may have been charged with unlawful sexual conduct because the crime was committed at present time but if it was committed when his father did his crime it may have been considered rape.

If they were in different states it might be a different name for essentially the same act. If they did this in the same state then perhaps your ex-husband got a softer judge. Even today people who do the same crime will get vastly different sentences depending on the judge. Finally, the judge who sentenced your ex-husband's father was really put off by the fact that he slept with his own daughter and decided to punish him more harshly.

Unlawful sexual conduct with a minor is described as one and the same, regardless of consensual or not when a minor is involved. The other example you gave must have been treated as incense and rape, since it was her daughter and also a minor, so he got the punishment for both, rape and incense.

difference in California is under the age of 14. because they are not old enough to make that decision for themselves.
