My husband ex dragged him to court and got 70k and 100% his pension.(sencond settlement). We had to pay in 15 days otherwise 1500 intrests per month. The court totally ignored he was currently unemployed, no money in the bank, and me - the second wife. (married for 3 years). I'm thinking to go appeal but my husband thinks he has no change to win becuase of the systerm (during the court hearing the judge even not allowed our solicitor to agure more than 1 min). Both of us think the court is not as we thought, it's an unfaire law & order. Now, we are worring about where to find the money ( my husband try to get a loan next week ), but I think diffirently. I want to persude my husband not to pay ( thinking we had to work 5 years to get over it!). Please help me, will he get arrested? Both of us don't want to pay her, all she thinks is get money from my husband and do nothing about herself. My husband paid her almost half the salary for almost 6 years plus 3 sons go to university.

children's ages: 20, 22, 24, we're still paying for them because the oldest went to study law after finish 1st degree.

If he simply "ignores" the court order your husband will face stiff monetary penalties.
It sounds as though he had a horrible lawyer and should hire a new one to file a motion for a new hearing.

How old are the children from previous marriage.. it is often the case that the woman with the children gets the most... but if they are all over 18/21 then this shouldn't really be an issue.

Not paying will cause many more penalties and really isn't worth the stress.

If you own your own home it sounds like this is what they are expecting you to give up in order to pay up... if you can prove that you have contributed more to the house (financially) than your husband.. you may be able to keep it and reduce the payments to ex wife.

I would say it is best to consult another solicitor and go for an appeal.. bancrupcy is another option but you will still lose the house over to the ex-wife uless the deeds are in your name alone. The fact that you have been married to the husband for three years should be taken into account but if that didn't worry them to start with then it may not worry them now..

sounds like the ex wife has a much better solicitor than your husband... go for appeal definately... up to you whether to look for a new solicitor, although it may be worth shopping around. May be able to argue human rights for taking 100% of pension.. can't see this being Just is any situation.

Hi,

There is something wrong here.Either there is something that you are not telling or the judge has got it very wrong. Before an award is made your husband must provide a statement of earnings and all assets so the judge can make an assessment on what is fair against what has been claimed.

You cannot be expected to go into debt like that if the assets are not there to justify such an action.

I would suggest you talk to a good family law solicitor.

File for bankruptcy looks like your only option, you are in a real tight situation, fire your lawyer, whatever you do the ex will keep asking for more and more and more and the charges will add up.I cannot see how she got 100% of his pension that does not sound right at all, get it checked out. Good luck to you both, you still have each other that is what she is knarked about.

He can file for bankruptcy, or hire a different lawyer and how can she get 100% of his pension? I seriously doubt that the judge ordered that unless the judge is ruthless or sleeping with his ex wife..
