Hello,
I worked for an automobile assembly plant for 12 years
Feeling unsure about my future employed for Ford I decided two months ago to take one of the three buyout options I was eligible for; the one I chose was the 4 year educational buyout. The requirement is that I must register for college full time, and maintain grade average of C or better.
They will pay up to 15k/year towards tuition.
I get my same health and dental benefits.
I will receive a stipend check that is 50% of my basepay, payable to me once a year

I live in Michigan.I believe Friend of The Court will probably take 65% of my stipend check.

As of now i can think of a couple questions reguarding my situation.
1) This wouldn't considered Imputing income... Would it?
2) As long as I could live off of the share of my stipend check after taxes/support; would I be required to get another job? I would like to dedicate myself 100%to my studies.

Im not trying to skate out of paying child support at all. One of my concerns is that they base support on previous years w4's and now I will be making about 60%+ less

From previous experience with the friend of the court, you'll have to make an appointment to go down for a meeting and explain the entire situation to them. It may also be a good idea to have your former wife present so that she can hear this information from the horses mouth. Just tell them that you had very few options and this was the best one they offered to you.

However, before going in there be certain you have all your ducks in a row. Take your paperwork as proof this is what you are getting. Also, take copies of all your expenses; rent, utilities, any auto payment(s), gasoline, auto insurance, (renters/homeowners) insurance, food expense and so forth. Don't let any expense escape them or you will not have enough to sustain yourself. Since that was your choice, they will only be convinced when you lay it out in front of them.

The case worker will then make the allowances based on your expenses, including the child support you pay now, and add/subtract any additional.

This is the best way to do things and continue to be up front with them. My ex got into a real bind when he gave his wife 'cash' and didn't have receipts to show that he was giving his ex enough for the kids and thensome. She had him arrested and I had to sell everything I had to bail him out. Believe me...it was not appreciated.

I do understand that at times they seem to ask for so much it is difficult to fathom that being honest would work out. However, if you try to fudge your way though this thing, you'll end up with -0- and they'll garnish your tax returns. This I know for a fact, because it happened to my ex. The state was taking it and then turning the money over to his ex...plus his regular work deduction until he was broke. They will side with your ex because she has the kids.

I hope this didn't disappoint you too much. I live in MI as well, and it was at the Macomb County Court and they were NOT nice.

Whether you get a job or not, they are going to make you pay support. Here is how it usually works. If you are not employed, after a reasonable time, they will average usually the last three years salaries, and you will have to come up with a way to pay the amount of child support you would have to pay based on that.

So, you're not going to get out of it based on the fact that you got the buyout, and are going to school. Somehow, you are going to have to pay child support.

Plan on getting another job while in school.

Concerning the "flip burgers" answer. That no longer works. Even though you lost your job, you are worth more than what unskilled labor makes. You will be expected to be able to gain income, and support the children in the fashion you previously did. While the support may go down a little, they are not going to let you take some min. wage job to get over on the system.

The money that you will receive is income but must be spent for education.

Get another job quick they can attach only one income from you current employer "flip buggers" let them attach that! do this now...
