Last summer I hired three employees to pick some berries for me. One day one of the men brought their wife without letting me know and I had never seen nor hired her. She said she broke her ankle while at work at my field. I had no knowledge she was even their nor did I ever hired her.Now she's claiming I must pay her compensation and she has gone as far as hiring a lawyer.One of the other gentlemen there told me she arrived after I had left and was already limping!she claims she broke her ankle while working at my berry field.she once came over asking for 2000$ saying that it would be sufficiant and I denied her.now she's suing but I never even employed her or asked her to be at my place.It sounds like a way to try me to give her cash but I never even authorized her being there much less work. what should I do. I know I can win but hiring a lawyer is too expensive.I dont have much $ but she somehow thinks I do Im just trying to get by paying for school what can i do

Lets look at this from a different point of view.You did not hire her.
I dont think she could get a lawyer to take her case and if he does he needs some kind of proof that she was an employee. In court it always comes down to proof on paper.....wait it out, dont spend good money on her, you didnt do anything wrong......

I agree with the earlier response of get a lawyer, but here is why: This is a sticky situation. I worked in retail for a while, and one of the things made clear to me was this: If I saw somebody who was not employed by the company I worked for working, I was to direct them to stop working and, if that didn't work, to notify security to attend to the person. There were several reasons for this including, at the very least, the following:

* a person doing work must be paid. Failure to pay such a person can be cause for serious fines to the employer. If she was working with her husband and you did know about that, you are probably screwed (read below) but if you didn't know, as I'm no lawyer, I'd guess you are probably still liable for that but not sure.

* a person injured while working while not employed or "on the clock" is a liability to the employer. Worker's Compensation covers an injured employee. Much costlier court cases and lawsuits cover those who are not employees. Obviously, most employers want to avoid this, but its probably (?) the employers' job to know who is working and who should not be working. (I'm no lawyer, so I could be wrong about "who should know" but common sense tells me I'm probably right.)

You might be able to get a lawyer to take your case pro-bono, especially if you can prove that she was injured before getting to your location as "one of the other gentlemen" you mentioned above had observed. Check with your local bar association.

Unless,upon hiring your workers you have them sign papers, you need a lawyer because if you give in to her blackmail, she will spread the word and you will have more expense than her claim.

Or,you could take her to an inexpensive small claims court as she has to prove her story and her friends are not realiable in that regard, and the court judge will certainly recongnize that!

if someone is suing you for an injury, you cant afford NOT to have a lawyer

if you have homeowners or renters insurance, they may provide defense, if not you've got to get your own

the courtroom is designed for lawyers, sad but true.

if they have a good lawyer, and you have none, you may be ordered to be silent, while others lie through their teeth against you

I recommend you shrink all ties with this human being. keep an in intensity record of each and every thing that has got here about. that is apparent you gave this guy extra personal thoughts than you should have and probable carried out better than you should have. you may pick to the contact your interior of reach authorities and percentage the data with them. yet to have further contact with this human being "even to get him" might want to implicate you better than you need to be. regrettably, those varieties are somewhat extra experienced at the variety of ingredient than we are. who cares if it cost money ur gonna win same thing happened to my family and he sued then he never showed up he was too scared maybe ull get lucky like my family.
