My girlfriend works in a supermarket and her boss stopped the direct deposit of her check because he wanted to ask her about a few minor things that she voided on her register. He didnt tell her about this and was off work for 2 days, so she got her check 3 days late. The voids turned out to be completely valid, so it was pointless and unfair in my opinion. But was it legal?

Your employer may not withhold your check. Laws may vary from state to state but as a rule if you are paid by the hour you must be given your check at the normal pay date and time unless the check for reasons beyond your employers control is unavailable. Questions about job performance including whether conduct is legal or in violation of policy and procedure are separate issues. Your employer may seek to have you pay for loss or damages but may not withhold your paycheck as a punitive measure no matter what the reason.

She got paid. If she was that worried about it she could have gone in there and got it resolved right away. Not fair, maybe. Legal - probably, because it was not held up for very long. Again, she might have saved herself the 2 days by taking care of it sooner rather than waiting 2 days.

Ask your labor board. Even if it was not legal, it would cost more than it's worth to sue. It would cost at least a couple thousand up front to get a lawyer. But the labor board may fine him.

HUM justbeing go back and read the question- the boss was gone for 2 days- and NO itr was not legal and she should make a complaint to the wage and hour people in her state.

I don't think he has any legal right to do that. None. She worked the hours HE required her to. Even if she DID void things illegally, he can't withhold her check. He'd have to sue her in civil court.

Under no circumstances can they with hold an employees paycheck! It is money already earned. She should (with a witness) confront her boss about this and let him know it is illegal, and if done in the future a lawyer will be contacted.

I don't think it is legal.
You are to paid for the hours you worked.
