Easter, Christmas, public holidays our paycheck is delayed going into the bank at least 3 days. No warning.
My husband is employed by a small business. When I asked the owner, he said 'plan ahead'.
Sometimes it is difficult with direct debits, mortgage etc
Is it legal for our pay to be so late? Does anyone know where I can check this out?
Thanks. Any advice appreciated.

--- for the record, most people do live paycheck to paycheck so three days can be a huge deal...if you're supposed to be paid on the 14th and the mortage is due on the 15th and debits never delay ---

Tangent aside, it may not be the owner's doing but on the processing end (banks are closed on holidays). In olden times (read a decade ago) you would have to wait at least three days for a check to clear before you get the money so it's not considered a delay that is unreasonable under the circumstances. Just like garbage pick up is delayed, etc.

Unfortunately, it really comes down to you have to plan ahead for it.

There is no law stating when an employee has to be paid - that is established upon hiring.

Have your husband check the policy and procedure manual of the business he works for. It should state something about pay. Other than that, if there is no policy or procedure on payroll, then all you can do is plan ahead during those times.

The delay could be due to their (the business's) pay being delayed due to the holiday. But there is no law that I know of. If you would like to check it out for sure, contact your state's labor dept, or check on the government's dept of labor website.

You have to check your state laws. The State laws are available in the public library. They regulate how you are paid. In the state of New Jersey you must be paid by the end of the business day on the pay day selected by your employer. If you are not New Jersey will warn the employer and the consecutive offenses fine him.

Be warned a small business owner may have reasons for this and will find away to penalize or fire your husband.

Your only option is not have the paycheck be sent to the bank but be given personally. Holidays, banks, and computers have the same days off.

It's legal, just that the mail doesn't get delivered on federal holidays.

If he has a work contract, it should say. But I think that in the absence of any agreement to the contrary, it should be perfectly legal. The law doesn't specify when paychecks are to be provided.
But honestly, why is 3 days such a big deal?
