I think you should threaten to call a lawyer only if you truly will follow through with it. I would try speaking to the manager first, and explaining your dissapointment...you'd be surprised, sometimes many businesses take that very seriously. If that doesn't get you anywhere, be sure to let them know that you'd never recommend them to anyone you know. This truly does hurt a business! Again, I would only cry "lawyer" if I truly intended on going that route...then again, I'm not even sure I'd warn them about it.

If you accuse you must be able to prove. Wise words I've always remembered. So how you going to prove who smoked in your car and (if they actually did) when that happened? They will deny that any of their staff ever smoke in a customers car and honestly a judge is going to lean in their direction. It doesn't make sense that a technician can't wait 5 or 10 minutes until he/she is out of the vehicle to have a smoke. I know you are upset and I know you believe this happened but I don't see you getting anywhere with this one unless you've got some witnesses to help you out. Let it go and buy one of those natural smoke sponges (I see them at Wal-Mart all the time). Finally, don't go back to that shop again and make sure the owner knows why you are taking your business elsewhere.

I can't see a car being in the shop long enough for smoke to permeate the car that deeply. One cigarette smoked fully in the car but not left in the car will dissipate pretty quickly. If they smoked while testing, there would likely be ash somewhere. Are you sure you don't have a neighbourhood vandal that tossed a butt down the vent in your dash? It costs you nothing to look. Good luck.

Unless you can produce a doctors statement that smoke is an immediate theat to your health, its just an 'annoyance law suit.'
You might win... or end up costing you more than the detail is worth. Get a stick up and slap it on the dash board and let the mechanic know you'll never use his services again.

Call the Lawyer, there may even be some smoke left in the upholstery.

Don't jump the gun and get all upset, talk to them...they will probably make things right. They are probably more concerned about losing a customer that they are scared of a lawyer.

You "smelt" it?? Let it go. You will be wasting everyone's time and money. Find something more serious to worry about.

If he is your regular dealer, then just forget about it. otherwise you may have to go to another dealer. Next time when you bring your car for service leave a small note " No smoking please"
