For all practical purposes, there is no "legal separation" in North Carolina, as is common in several other states. The NC General Statutes, however, set forth that one of the grounds for absolute divorce in NC is separation for one year. In this context, separation is deemed to begin at such time that the parties begin actually living "separate and apart" from one another. A true separation does not commence until one party has actually left the residence and is living elsewhere. Living in two separate rooms within the same residence does not begin the date of separation.
