If you are still legally married to your 1st husband even if you do not see him for 50 years, unless he is dead, it is still legally binding. This would make getting married to your current man Bigamy, and that is illegal.

You should be able to track him with his Social Security #. Good luck to you.

My best friend is in the same situation. She had only one child by her husband, but has 4 with the man we all consider to be her husband. What she was told was that since she was married in California, she has to return to California and be a resident there for 6 months to be able to file for divorce. Contact the legal aid in the state you live in and ask them. They'll know what to do. My best friend has been with her current 'husband' for 15 years now, and everyone who knows them considers them married. Marriage is more than a piece of paper, so even if you can never legally marry this guy, you can still be his wife.

Each state will have its own laws which a lawyer should be able to answer w/in the 30 minute free consultation time.
You can have a minister bless the marriage w/o a state license. Some will, some won't.
Most insurance policies can handle the beneficiary issue and many of the health policies at employers as well. You can choose to live as partners! w/ different last names or simply introduce yourself as Mr/Mrs. The wedding is blessed by God, but used by the state to track/formalize marriage.
Congrats and well done on raising the 5 children. We only managed 4 and my hair is gray.

You are still married so no you cannot marry this guy.... Go to legal aide or get the money to divorce first!!! Divorce him for abandonment since you cannot find hiim. If you want to marry this guy then divorce your current husband.

If you married without a divorce from your first husband your
new marriage would be illegal.
Do you have a ssn# for your ex-husband ? look on your old marriage certificate , on your children's birth certificates, a tax return, that one number stays with you for life and very reseachable.

NO, it's not legal, you have to get a divorce and claim abandonment.
