There have been a few studies recently that seem to suggest that a high portion of the people who contract herpes, contract it when there partner is NOT having an outbreak, so to be safe I would always use a condom.

Transmission
Herpes is contracted through direct skin contact (not necessarily in the genital area) with an infected person, and less frequently by indirect contact (for instance, by sharing lip balm or a virus infested shared towel). The virus travels through tiny breaks in the skin (or mucous membranes in the mouth and genital areas), so, healthy skin and mucous membranes are normally an effective barrier to infection. However, in the case of mucous membranes, even microscopic abrasions are sufficient to expose the nerve endings into which the virus splices itself. This is why most herpes transmission happens in mucous membranes, or in areas of the body where mucous membranes and normal skin merge (e.g., the corners of the mouth).
Symptoms may not appear for up to a month or more after infection.[citation needed]
Transmission was thought to be most common during an active outbreak; however, in the early 1980s, it was found that the virus can be shed from the skin in the absence of symptoms.
It is estimated that between 50% and 80% of new HSV-2 cases are from asymptomatic viral shedding. (which means when there is no outbreak)

Yes, you can pass Herpes even if you don't have an out break, as a matter of fact, its mostly passed on when their is no symptoms of an outbreak. Their is medication to prevent the passing on Herpes. I would talk to your doctor about this. Can I ask you why do you refuse to use a condom. If your not careful, the next disease you could get is HIV, which eventually turns into AIDS and is ultimately fatal. Do you really want to die when your young. Why don't you wait until you are married to use no condom. I would say the chances of spreading Herpes provided you didn't take any medication to prevent passing the Virus and didn't use a condom, they are at a 60%-75% likely to get it. If your x b/f or husband didn't tell you they had the virus and they knew they had it by a verified Herpes test, you can take legal action against him. I would talk to a lawyer about this.

Most people contract genital herpes when their partner is not having an outbreak. You should ALWAYS use condoms and continue to take Valtrex as your doctor prescribes. Valtrex is safe in pregnancy, it is Catagory B same as Tylenol. Remember that you can pass herpes along even w/ condom use so don't be like your baby's dad and aviod telling your partner that you have herpes.

Never have unprotected sex with someone else even when you're not having an outbreak! It's way too risky on passing it on! Sorry to hear about your situation. That's gotta be tough.

You have to use condoms, even if there isnt an outbreak. And you really need to talk to Dr more if you arent understanding the disease.

Um I have no clue, but i am soooooo sorry what happened to u. If this wasnt the first STD he gave u then i think u are kinda dumb for continueing to have sex after u know how STD infected he is. thats kinda..... stupid. But im sorry ur going throught this anyway. its sad!
