It depends on who finds out -- something between nothing to tax penalties. What happens when someone asks a question and places it in a category it has nothing to do with.

If someone else claims that dependant, the IRS will find out. They will have two 1040s listing the same dependant name and social security #. You will get audited and penalized with fines.

If the real guardian doesn't claim, it's a lot less likely they'll discover it.

If or when the IRS finds out you can face criminal charges, heavy fines etc. Serious audit of many of your tax returns at the very least.

You could be sued for tax fraud. This could mean a money penalty and/or jail.
