If I'm not on the mortgage, yet live in the home and have paid for the purchase of the home and pay 1/2 the mortgage and utilities. Can I 'legally' write off 1/2 the interest?

If your have not signed the mortgage agreement you are not responsible for one single dime. But if your partner becomes the owner, you can claim your proportional share, provided you can prove what you payed, eg from your bank a/c records.
