That isn't so. The court usually gives the children to the person who has been taking care of them since the begining. What I have noticed is that if the mom was a stay at home mom, yes, she gets custody because the kids are used to being around her. She has been their main caretaker. Unfortunately the other parent doesn't get as much credit as they should, but that should change as the children get older. Also, if both parents worked them the trend seems to be joint custody. My ex and I have joint custody and he has primary care because his working hours are better for our daughter. He has her 4-5 days a week and I have her the rest. Depending upon schedules. We live in the same school district approx. 2 miles from each other so that her life stayed relatively stable. Not many people are willing to do that. It was a sacrifice worth making. It would be cheaper for me to live elsewhere but it is in her best interests. If only people would really put the best interests of the child first!

Wow, your assumption is just not correct. We're an equal rights amendment state (in our state Constitution) and what you are saying just is not true. The Courts in my state MUST consider joint custody. The basic determining factor is what is in the best interest of the children. The events you describe could be attributed to the fact that the parent on welfare was the primary care-giver for the children during the marriage. In my state, the Courts also have to consider the wishes of the children as to which parent they wish to be the primary custodian.

Thats not the methodology they use to award custody. Unless there is a compelling reasong not to they almost always award primary custody to a childs mother. Means to care for the child are a consideration, but Welfare and other assistance provide the means.

2 jobs is probably 80plus hrs a week working school only takes up a small part of the day why have a babysitter raise your kid when your kids other parent who is willing to give physical emotional and other support to the child
Child support only goes so far you know

Why can't deadbeat parents help the hardworking parents support their kids? I work my *** off and my daughters father can't support her because his wife needs him to support her 5 kids so she doesn't have to work. God forbid he supports his 1 biological child...
