If he has a good mind he should be able to tell them he wants to leave. If your husband is power of attorney he could help him get out and go home.

There is no limit on the amount of time medicare pays. He is eligible for medicare because of his age. If your husband has the power of attorney, you can get him out of the nursing home now. Medicaid is a similiar program, but only pays nursing home care if he needs skilled medical care. Diabetes isn't enough, but dementia probably is, depending on how severe it is. Medicaid will not pay until your father-in-law uses up his assets. There are assets he is allowed to keep, but those guidelines are set by each state, even though it is a federal program. With a durable, general Power of Attorney, your husband can do anything he thinks is best.
