Sometimes you can get handsets that are not locked, but not many. To tell if a handset is not locked you need to take out your simcard and put another network providers simcard in, if the phone comes up with the logo and a signal then you'll know its unlocked. If it is locked then it will display a message something like unregistered simcard.
A rule of thumb is that most uk mobile network providers will unlock a handset free after the contract has expired. The only network provider I know of that charge is 3 (three).
The second part of your question is that You have to have a simcard inserted in the phone.
The simcard provides info like contacts if saved to the sim, and account info etc. The phone will not work without a simcard.

If you are not going to continue with the contract or upgrade you can put in a pay as you go Sim. Some networks lock the phones though. That means you could put in a pay as you go Sim but only for the network which you were on with your contract. If it's not locked you could put in any Sim. You must have a sim card for a phone to work. A phone is "locked" in two ways. One is the service provider and the other is the services available. So if you have an ex-Orange phone it won't work with a Virgin sim card until it is unlocked. The services differ between pay-as-you-go phones and contract phones so some services are "locked" (greyed out) on paygo phones.

some mobile networks give out phones opened up on all networks so when u finish with your contract the phone it is yours to do what ever you want try different sims cards to test it out

If the phone is unlocked, it will work with any network. If the phone came directly from Cingular, or T-mobile, you can guarantee it is locked. You can easily get this phone unlocked from somewhere online, or ebay.

The only way round this my friend is take it to a local unlocking shop and have them read your phones details with their software, your unlock code appears on their info and they can reset this for you. Gd Luck
