The only penalty is that if you 2 have children. You would have to pay what we call "Child Support" meaning that you would have monies garnished from your pay check and that will be paid to your wife. You will also have to provide health insurance for your children. Both child support and insurance will have to be paid unitl the children turn 18 years of age. There are also some states that have what is called Alamony. Which is monies paid to the ex wife. Both child support and alamony is deturmined by the courts. My advise to you is get yourself a GOOD lawyer!

No penalty law wise, but the man gets to be broke.
