What are the reasons... people don't just throw a life away on a whim there must have been some catalyst.
A Cheating husband or have you found what you believe to be a new love?
Constant fighting over nothings...
Have any counter measures been taken .... IE Counseling etc.
Your call but remember your affecting not just your life but the lives of your children too

When you become divorced everything will be on you for a little while till you get through the court. As so as the divorce is finalized the judge will determined how much of the money you spent while in process of the divorce and your ex will have to pay you half of it, Shared coasted is an ok situation if he is going to help you financely.

As a matter of a fact I'm going threw the same thing but they have a thing threw the court called a deferral and depending on your income and what you pay they will help you now on my income I didn't have to pay anything, now I don't have kids with mine so yours will be a lil more paper work but I went threw one of those divorce company's that only charge 200$ and the help you with everything they do all the paper work and tell you exactly what you need to do they helped me a lot. and I'm just playing the waiting game now. If this is not because he is cheating.... Then I would suggest that you stay together and try to work things out! The reasons that I think this are listed in you question: 10,8 yr olds and a 7 month old too? Oh, unless he is beating you and them! then get out and run fast!E-mail me for real help on this as I have been through all of what you are saying.

You could file for divorce through the court yourself, and see if you qualify for the deffered or "excused" fee. OR you could file and request that he pay for it. It sounds like there's not going to be a big fight as you're not asking for much, way less than what's fair for you to have, so if he agrees to everything, then filing it yourself will save you both a lot of money. I'm not sure what state you're in, but some states offer online form packets, or even "ecourt" access where you just plug in info, and it prints out the packet, then you take them to the court, pay the fee (or request a defferred or discounted fee), then that's that. You just wait for a response, then request a final hearing and "batah boom batah bing"!

It is simple. If you are absolutely sure that the marriage is irretrivably broken, have tried all avenues to save it and believe that you and the children will be better off if you divorce their father, then hire a lawyer and file the petition for dissolution. Then you are officially on your way.

Contact your local bar association and see if they have any reduced fee attorneys. Divorces with children can be difficult at best.

Just file for divorce already. What's the big deal?
And, just get rid of the kids. They were probably a mistake anyway, right?
Divorced people with kids are people who NO ONE wants to be with. At least jettison the kids, and you'll have a slim chance of not being alone for the rest of your life.
