My friend got REALLY drunk at this party and passed out on a bed in one of the empty rooms. She told me about this the next day but she said that someone came in and had sex with her. She said that if she were sober then she wouldn't have even had sex with anyone. She knew what was happening but was SO drunk that she was coherent enough to stop it, i guess. Is that classified as rape?

She doesn't know who the guy was and i read most of the answers down there already and some asked why she would get so drunk in the first place...because she was having a really bad night. But that's another story.

Two things she needs to do:
1. go to a clinic or her dr. and tell them what happened and get tested for STDs and pregnancy. She should probably get retested for STD's in about 6 months, but the dr. will tell her for sure
2. Go to the police and file a report. You do not need to know who the person was to file a report. I was sexually assaulted by a homeless person and was able to file a report without problems. They even went with me and trying to find the guy. After filing the report, there may not be much they can do, but they can question people at the party and see if they can find witnesses, etc.
It's very important for your friend not to allow herself to get in that type of situation. If they ever go to a party, whether drunk or sober, a guy will still try to take advantage of her, so it's always good to stay sober and try to prevent that from happening again. I also recommend bringing your own drinks to the party b/c of folks trying to spike non-alcoholic beverages. She also needs to always watch her drink and keep it in her vision at all times while at a party because of date-rape drugs, which have a similar effect to being drunk. Date-rape drugs like GHB and Rohypnol basically incapacitate a person like the drunken stupor your friend was in and sometime the victim is aware of what is going on, but not able to say "NO!" or "STOP!" These drugs are illegal and someone being raped with these drugs can sue and file claims because even though they were not able to say stop or no, it was because they were unable to, same thing with your friend. Your friend needs to know her limits with alcohol as well. Alcohol may temporarily help her not feel pain or hurt from a bad day, but she just learned the hard way, it doesn't work because her bad day just got a whole lot worse.

It is statutory rape if she is a minor. If she is over 18, it seems like it could be rape. Only 2 people really know what happened that night. If your friend has not showered, she should get examined by a doctor. Your friend should really sober up before she has more serious problems. Your friend didn't say "yes", but she didn't say "no" either. She should definitely get tested for STDs and take the morning after pill.

Rape is having sex without a person's consent. Of course it's rape. You should report it and when they ask you why didn't you do nothing about it just tell them the truth. So get to it before it's too late. Because if she doesn't know who it was go for a check up and find out if she didn't get pregnant or a std. But make sure you file a police report.

yeah I would consider that rape. If she was sober she would have said no, and is could relize what was going on she would have stoped it. So the guy did go against her wishes, even though she was passed out. He is a loser if he has to find drunk girls to have sex with!

Yes, it is. I would suggest that your friend go to the local clinic and get tested for STD's and HIV. Also take a pregnancy test. This is a very dangerous situation, and it happens all the time. I would suggest that your friend become familiar with her drinking limits and you as a friend should go with her. You should never attend wild parties where there is excessive drinking alone. I guess your friend can take this as a lesson learned. I would also suggest to her to consider some counseling to help get over this issue if it bothers her.

I guess it could be! A guy has no right to have sex with a drunk girl, unless she makes it REALLY obvious she wants to! If there's any doubt whatsoever, then yes, it's rape.

It is definitely considered rape because she did not consent. Most juries will convict even if the guy was drunk as well.
