nephew is dating a 16 but legal guardian doesn't like him and would like to press charges, the girl does not want to and says she cares for him

he is 24, the guardian says they are,if she can't even prove this can she press charges

You did not mention your nephews age. In most states, an adult is considered to be 18 and older. The laws against statutory rape however, do not bar dating, just sex. A 16 year old is not usually considered old enough to consent to sexual intercourse with an adult.

You didn't say how old your nephew is. Is he also 16? Is the girl 16? Capital letters and periods would make your question easier to read/answer!
Are they actually having sex? Why do you know that?
I suggest you either do a Google search or call a lawyer or legal source for information.

it's Statutory, and I'd tell the nephew to wait two years. Nothing but trouble can come from pushing the issue.

that is stauttory rape. doesnt matter if its consensual.
