Good catch on the fact that people do not seem to understand that this would have been an amendment to the Constitution, thereby making the law against flag-burning Constitutional.
I guess I don't understand the big deal about flag-burning either way. Americans who burn the flag are just demonstrating their utter stupidity and reliance upon childish symbolism as a substitute for rational ideas.
But what I really don't understand is the liberals who talk about the 1st Amendment right to burn the flag, but who remain silent on the curtailment of the same right caused by Campaign Finance "Reforms", or when a high school student is prevented from mentioning their faith in a graduation speech, or their support for the "Fairness" Doctrine.
I guess they are very selective about what free-speech they care about.

Why is it that some people cannot realize that we cannot legislate morality and that miniscule issues are not worthy of amending the Constitution. If we did that we would be on the thousanth and something amendment. When was the last time Americans burned a flag? Why did they do it? For one thing they did if for attention. Don't give them the attention and they won't do it. They will find some other way to get attention. They have the right to make idiots of themselves. A Constitutional amendment for every little thing imagine the mess we would have in federal court with all the constitutional violations. People would be afraid to breath for fear it might be unconstitutional.
The founding fathers made it difficult to amend the Constitution for a good reason. The did it to keep radicals with special agendas from dumping unnecessary junk on that most brilliant of document.
By the way flag burning is legal in this country. It is how a flag is supposed to be retired.

Obama isn't liberal, he's pretty moderate.
Boxer is very liberal.
Lieberman is more conservative than liberal, and currently an independent who will vote with the democratic block.
Kennedy is an old school Democrat, and while more liberal than many isn't as liberal a public perception.
Clinton is ranked as the most moderate of the Democratic Senators currently in office.
Byrd is another old school Democrat like Kennedy.
Biden is fairly liberal, but not in the same league as Boxer.
What they all have in common is that they are all great Americans who stand up for the American people and defend the Constitution.
You "flag burning" garbage is just that. It's a divisive propaganda ploy to further divide the American people, and to smear fine Senators while avoiding real issues. I didn't realize that flag burning was such a big issue that it should even be mentioned on the national stage, probably because it isn't. The reality of the situation is that the flag burning issue is not one that the majority of Americans even think about at all, unless it happens right in front of them. The pathetic part of your attempted smear of these fine Americans is that E. Dole R-NC, a Conservative Republican also voted against the measure, and she wasn't the only Republican to vote against it.
So all the Senators you mentioned were agreed with by Elizabeth Dole, and disagreed with by the most liberal Senator, Diane Finestein.

you know you are partly right!!! some people do not know their constitutional rights and amendments.. like you for one. I am not saying it is moral or right, but it is not illegal and is part of what is called the freedom of speech. its the same freedom of speech that gave you the right to post this question.
But you want to know what they all have in common with each other imo? they have got to be better then ole bushy boy.. just because you do not agree with what someone does or says does not neccessarly make it wrong.

I think flag burning, and cross burning, are both disgusting.
I would not make either unconstitutional.
I would only prohibit them to the extent they are also committing another crime (arson, harassment, etc.)
Among other things, a constitutional amendment would make martyrs out of a few jerks. Don't give them the attention.

I think the flag burning issue is only there so single issue people will not realize congress is ignoring much bigger issues. It is a moot point, not worth the time and effort being expended.
Now, since you raised the issue: WHAT IS THE ONLY ACCEPTED METHOD OF DISPOSING OF A WORN OUT AMERICAN FLAG?

I mean its almost like they think this is such a non issue because it rarely happens it is not worth voting yes for.
We dont need an amendment for flag burning. Seriously how often does something like that happen? It is a non issue put out to distract people from real issues. Like gay marriage and abortion.
